GOVERNMENT PROCUREMENT REFORM ACT - R.A. 9184
Functions of the BAC
Bids and Awards Committee shall have the following functions : advertise and/or post the invitation to bid, conduct pre-procurement and pre-bid conferences, determine the eligibility of prospective bidders, receive bids, conduct the evaluation of bids, undertake post-qualification proceedings, recommend award of contracts to the Head of the Procuring Entity of his duly authorized representative
BAC Secretariat
To assist the BAC in the conduct of its functions, the Head of the Procuring Entity shall create a Secretariat that will serve as the main support unit of the BAC. The Head of the Procuring Entity may also designate an existing organic office within the agency to serve as the Secretariat.
The Bids and Awards Committee :
a.) reserves the right to reject any or all bids;
b.) waive any defect or formality;
c.) declare failure of bidding if there is prima evidence of any prohibited act which restricts, suppresses or nullifies any or all bidding procedures to the disadvantage of the government;
d.) assumes no obligation whatsoever indemnify the bidders(s) for any expense that they may incur in the preparation of their bids; and
e.) to accept only such bid(s) established to be the most advantageous to the government.
PROVINCIAL ORDINANCE NO. 2007-008
PRESCRIBING THE RATE OF SALE OF THE BIDDING DOCUMENTS TO INTERESTED SUPPLIERS AS AUTHORIZED UNDER IRR-A OF REPUBLIC ACT NO. 9184, OTHERSE KNOWN AS THE GOVERNMENT PROCUREMENT REFORM ACT AND OTHER ISSUANCES.
BE IT ENACTED by the Sangguniang Panlalawigan of Davao del Norte in Session Assembled, that:
SECTION 1. Letter A of Section is hereby introduced as Scheduled of Fees, to wit:
Rate of Bidding Documents:
Approved Budget for the Contract - Maximum Cost of Bidding Documents
P500,000.00 and below - 500.00
More than P500,000.00 up to 1 million - 1,000.00
More than 1 million up to 5 million - 5,000.00
More than 5 million up to 10 million - 10,000.00
More than 10 million up to 50 million - 25,000.00
More than 50 million up to 500 million - 50,000.00
More than 500 million - 75,000.00
SECTION II. EFFECTIVITY. This ordinance shall take effect immediately upon approval.

PROVINCIAL ORDNINANCE NO. 2009-007
AMENDING PROVINCIAL ORDNIANCE NO. 2007-008, PRESCRIBING THE RATE OF SALE OF THE BIDDING DOCUMENTS TO INTERESTED SUPPLIERS AS AUTHORIZED UNDER IRR-A OF REPUBLIC ACT NO. 9184, OTHERWISE KNOWN AS GOVERNMENT PROCUREMENT REFORM ACT AND OTHER ISSUANCES.
BE IT ENACTED by the Sangguniang Panlalawigan of Davao del Norte in Session Assembled, that:
SECTION 1. That the Rate of Bidding Documents particularly in Section 1. b shall be amended as follows:
B. CIVIL WORK
50,000.00 to 150,000.00 150.00
150,001.00 to 1,000,000.00 250.00
1,000,001.00 to Above 500.00
SECTION 2. REPEALING CLAUSE - All provisions of existing Provincial Ordinances, Order or Regulations inconsistent herewith are hereby amended/modified/repealed accordingly.
SECTION 3. EFFECTIVITY - This ordinance shall take effect immediately upon approval
