AN ORDER PROVIDING AMENDATORY AND SUPPLETORY POLICIES AND GUIDELINES TO EXECUTIVE ORDER NO. 07, SERIES OF 2021, WHICH IS AN ORDER PLACING THE ENTIRE DAVAO DEL NORTE PROVINCE UNDER THE MODIFIED GENERAL COMMUNITY QUARANTINE (MGCQ) BEGINNING

WHEREAS, the Philippines remain to be under full alert amid the ongoing Coronavirus Disease (COVID-19) pandemic around the globe and the revived threats of its new UK variant that hit the country anew;
WHEREAS, the IATF-EID was duly created by virtue of Executive Order No. 168, s. 2014 to facilitate inter-sectoral collaboration to establish preparedness and ensure efficient government response to assess, monitor, contain, control, and prevent the spread of any potential epidemic in the Philippines;
WHEREAS, since the COVID-19 outbreak in the Philippines, the IATF-EID has implemented community quarantine restrictions of varying levels nationwide to counter the further spread of the virus in other areas of the country;
WHEREAS, following the recent pronouncement of the National Government that places Region XI, except Davao City under the Modified General Community Quarantine (MGCQ) beginning 01 March 2021, the Provincial Government issued Executive Order No. 07, series of 2021, providing for the policies and guidelines in the implementation of the MGCQ in the entire Province for the period March 01-31, 2021;
WHEREAS, there is a need to amend and add to the existing policies and guidelines provided under Executive Order No. 07, s. 2021 to streamline and codify rules applicable to the MGCQ classification of the province, pursuant to the latest amended IATF Omnibus Guidelines as of 18 February 2021, the DOTr Memorandum dated 27 February 2021, re: Approved Standardized Travel Protocols for Land, Sea, and Air, and the DILG Memorandum Circular No. 2020-140 dated 23 October 2020;
NOW, THEREFORE, I, EDWIN I. JUBAHIB, Governor of the Province of Davao del Norte, by virtue of the powers vested in me by law, do hereby order the following:
Section 1. Amendatory Polices and Guidelines. The following amendatory guidelines and policies are hereby imposed, to wit:
1. Section 2(4) of Executive Order No. 07, series of 2021 shall now be read as follows:
Any person below 15 years old, those who are 65 years of age and above, those with immunodeficiency, comorbidities, or other health risks, and pregnant women shall be required to remain in their residences at all times; Provided that all activities and movements allowed under other sections of the IATF Omnibus Guidelines for the foregoing persons shall continue to be permitted under MGCQ.
2. Section 2(12) of Executive Order No. 07, series of 2021 shall now be read as follows:
Except as otherwise provided below, all permitted establishments and activities under Categories I, II, and III of Section 4(6) and those in previous sections of the IATF Omnibus Guidelines shall be allowed to operate or be undertaken at full operational capacity.
a) Barber shops, salons, and other personal care service establishments, at a maximum of 50% of venue capacity;
b) Dine-in restaurants, fast food and food retail establishments, including those in supermarkets, grocery stores, and food preparation establishments, at a maximum of 50% of seating capacity;
c) Category IV and all other establishments not permitted to operate under previous Sections of the IATF Omnibus Guidelines, at a maximum of 50% operational capacity. Notwithstanding the foregoing, the DTI is authorized to issue a negative list of industries which shall remain prohibited even in areas under MGCQ.
3. Section 2(21) of Executive Order No. 07, series of 2021 shall now be read as follows:
Illegal and unlicensed gambling activities are strictly prohibited. The operation of licensed cockpits and conduct of cockfighting activities may be allowed, subject to the conditions provided under DILG Memorandum Circular No. 2020-140 dated 23 October 2020.
Section 2. Suppletory Policy and Guideline. The following suppletory policy and guideline is hereby added and imposed, to wit:
1. There shall be standardized travel protocols agreed by all LGUs of the Province for Locally Stranded Individuals (LSIs) and Returning Overseas Filipinos (ROFs) in consultation with DOTr Memorandum dated 27 February 2021. As such, the Provincial Government shall issue a Memorandum Circular to this effect.
Section 3. Separability Clause. If any part, section or provisions of these Executive Order is held invalid or unconstitutional, other provisions not affected thereby shall remain in full force and effect.
Section 4. Penalty Clause. Any violations thereof shall be dealt with under our existing laws, ordinances, rules and regulations.
Section 5. Effectivity. This Executive Order shall take effect on 01 March 2021 and shall remain in full force unless revoked or amended.
